HICKORY Additional charges have been filed by the N.C. Division of Alcohol Law Enforcement following a fatal accident April 18 in Surry County.
ALE Special Agent Stacy Cox filed charges against 21-year-old Filberto Hernandez of Dobson for aiding and abetting underage possession of alcohol. Luke Van Horn, 19, of Dobson was charged Nov. 25 with two counts of aiding and abetting.
The charges come after an extensive investigation involving the death of Michael Dehart, 19, of Ararat, a passenger in a vehicle allegedly driven by 19-year-old Joshua Hembree, who was charged in November with involuntary manslaughter and felony death by motor vehicle. In addition, the State Highway Patrol charged Hembree of 2637 Ararat Road, Ararat, with driving while impaired.
Hernandez, Van Horn, Hembree and Dehart had allegedly been at a party in a remote cabin in Thurmond when Hembree and Dehart left for their home in Ararat. At 7 a.m., Hembree ran off the road and struck a tree eight miles northwest of Pilot Mountain on Ararat Road.
ALE, the Surry County District Attorneys Office and the North Carolina Highway Patrol conducted the investigation.
