Ethics charges filed against county board

DOBSON — A county resident has filed an ethics complaint against the Surry County Board of Commissioners and County Manager Dennis Thompson, charging that their April 16 resolution supporting the Marriage Amendment on today’s ballot is in violation of the Surry County Code of Ethics and Professional Conduct for employees and elected officials.

Steve Noga, U.S. Army Retired, said that in unanimously passing the resolution the board “went beyond (its) official elected capacity and publicly adopted your personal religious views to sway voters and influence the outcome of the ballot initiative.”

“That is against the law,” he said when he addressed the board during open forum at the start of the meeting. “The office of Surry County commissioners is not a political or religious organization who can freely endorse one political platform or ballot initiative.”

Noga is calling for the board to publicly recant the resolution, publicly apologize, reimburse the taxpayers for the labor, supplies and utilities used during what he called the “promotion of your personal political agendas” and pass a resolution prohibiting future boards from endorsing any election or ballot initiative.

The Surry County Code of Ethics and Professional Conduct states in part:

“I will avoid inappropriate participation in partisan political activities,” and refers commissioners to Article V. Section 3 of the Surry County Personnel ordinance.

That ordinance mandates, in part, that “no employee shall 1) engage in any political or partisan activity while on duty; 2) use official authority of influence for the purpose of interfering with or affecting the result of an election or nomination for office.”

While the personnel ordinance specifically exempts county commissioners and county managers from the personnel ordinance, the Code of Ethics refers them to the same ordinance.

In an impassioned plea, the retired soldier said the board had overstepped its bounds with the resolution.

“(Commissioners’) official endorsement of the Marriage Amendment is definitively political and beyond the scope of your office,” he said. “That was unethical and against the law.

“Your religious views do not reflect the views of every Surry County citizen,” he said. “You abuse your position and authority. Your actions are reprehensible.”

Noga said he, too, is a Christian.

“My Christ loves me for who I am. My Christ has blessed me with a wonderful partner for more than 18 years,” he said. “My Christ blesses this union.

“For one religious group to impose laws against the religious beliefs of another is wrong and violates my Constitutional rights to religious freedom.”

After Noga addressed the board, county resident Doria Faye said she agrees with him.

“There is a growing number of people in this county who find it offensive that you took the position you took,” she said.

Board members declined to comment on the issue pending consultation with the county attorney.

I am a Proud American Veteran, I hold Christian Values in my heart that differ from your own and I just happen to be homosexual. Stop making this issue into a Gay Debate.

My complaint is against the County Commissioners for violating Their Own code of ethics and breaking the law. Period.

I too applaud Mr.Noga. Sir, if there is anything other citizens could do to help you in this fight for justice and what's right, please let us know. I think they're many people who feel the same way as you, however they did not know what steps to take to put a stop to the obvious abuse of power and the misconduct of our elected officials. Please let the general public know if we can assist you in any way in this fight that will benefit all of us.

I applaud Mr. Noga for his efforts to study the ethical rules that govern our county board and take time to file a complaint. What the board did was plain and simply wrong and they should be held accountable for their actions.

No it wasn't wrong...it was GOD's WAY....you all need to get a life....Our county commissioners done what was right in the eyes of our GOD.. If he (Snoga) is the so called Christian he claims to be then he would be behind our county commissioners..because Homosexuality is a disgrace in the eyes of OUR GOD HERE IN SURRY COUNTY...IF he DOESN'T LIKE THE WAY WE DO THINGS IN SURRY COUNTY MAYBE he NEEDS TO GO BACK WHERE he CAME FROM. We Christians here in Surry County are taking a stand for our beliefs and standing behind our county commissioners. You all need to get your heart right with GOD and quit sugar coating everything to make it right in your eyes....they (the County Commissioners) were only doing what GOD wanted them to do.

well I for one can say that our commissoner has done a great job the charges should be drop becasue every other county in the state has passed similar resolution there for are they gulity of ethics should be happy that our commisoner took a stance sa that a marriage should be between one man and one women not man and man or women to women if this gentlmen doesn't believe in god then he needs to got to church

Actually, the Commissioners and County Manager should be contacting their personal attorney, rather than the County Attorney. The complaint is against them, not the County, for their personal actions. Taxpayers should not be paying their legal fees for violating both the County Code of Ethics and the 1st. Amendment to the U.S. Constitution. Oh well, maybe those don't count any more.

In the positions that each of these commissioners hold, it is remarkable that not one of them is aware of the laws and ethics that they are to uphold and enforce. This community could surely benefit from your services and others like you. I VOTE for you! Again, thank you!
